We may link to third parties via our Services. Droppz Privacy Policy does not apply to how third parties define personal data or how they use it. We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

  • Name

  • Postal address (for delivery)

  • Phone number

  • Email address

  • Photo of driver’s license or Government issued ID (age verification)

  • IP address, or other similar electronic network identifiers

  • Medical cannabis card or recommendation document

  • Purchase records, browsing history, and or any interaction with information regarding the use of Droppz services  

Sensitive Information. Photo of driver’s license or state identification and geolocation.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

 

Websites and other technologies. Cookies are pieces of information that a website transfers to an individual’s hard drives for record-keeping purposes. Most web browsers automatically accept cookies. Typically, however, you may configure your browser to refuse all cookies or notify you when a cookie is being sent. Droppz may (1) place cookies on third-party websites and/or (2) use third parties’ analytic and tracking tools to better understand who and how people are using the Droppz Services and how to improve the effectiveness of Droppz Services, and to help serve more targeted advertising to you. Droppz, and/or third party companies, such as analytics and advertising partners, may use cookies, pixel tags or other technologies to collect and store anonymous information, such as time of visit, pages visited, time spent using the Droppz Services, device identifiers, type of operating system used and other website(s) you may have visited. They might combine information they collect from your interaction with Droppz Services or on third-party websites with personal information they collect from other sources. We do not have access to, nor control over, third parties’ use of cookies or other tracking technologies. You can block cookies by setting your internet browser to block some or all cookies. However, if you use your browser settings to block all cookies (including strictly necessary cookies) you may not be able to access all or parts of Droppz Services. By using Droppz Services, you consent to our use of cookies and our processing of information collected through such cookies, in accordance with this Privacy Policy.

 

You may opt-out of such targeting advertising by selecting the appropriate settings on your browser, however, please note that if you do this you may not be able to use the full functionality of Droppz Services.

 

If you click on a link to a third-party website or service, a third party may also transmit cookies to you. This Privacy Policy does not cover the use of cookies by any third parties, and we aren’t responsible for their privacy policies and practices. Please be aware that cookies placed by third parties may continue to track your activities online even after you have left Droppz Services.

 

2. HOW DO WE PROCESS YOUR INFORMATION?

Personal Information you provide to us is used to help us communicate with you and to provide you with the Services. We use personal information to: (i) register and service your Droppz account; (ii) solicit feedback and respond to your questions; (iii) provide technical support; and (iv) inform you about products or promotional offers. In order for our Vendors that you select to process your order, we will send them your name, email address, phone number, reservation time, delivery location, and the specific products and the quantities you ordered. We may also provide our Vendors that you select with suggested products for you based upon information that we gather about your shopping history or consumers with similar shopping histories in your area. If purchasing from a product manufacturer's menu, we will send the product manufacturer your name, email address, phone number, reservation time, delivery location, and the specific products and the quantities you ordered. We may also provide the product manufacturer with suggested products for you based upon information that we gather about your shopping history or consumers with similar shopping histories in your area. We may also share your information internally between Droppz Services to provide a seamless experience for you between the Droppz Services. For example, based upon information that we gather about your shopping history on our website or app for consumers with similar shopping histories, we may provide product recommendations to you through the POS services when you are shopping at a Vendors website or retail location.

 

We also collect data in a form that does not, on its own, identify any specific individual (non-personal information). We may collect, use, transfer, and disclose non-personal information to improve the Droppz Services and customize the user experience, or for any other legitimate purpose. We also may aggregate non-personal information in order to track trends and analyze use patterns on our Services. The following are some examples of non-personal information that we collect and how we may use it:

We may collect information such as language, zip code, area code, unique device identifier, referrer URL, or location so that we can better understand customer behavior and improve our products and services.

We may collect information regarding customer activities on our Services. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our website, products, and Services are of most interest. Aggregated data is considered non personal information for the purposes of this Privacy Policy.

We may collect and store details of how you use Droppz, including search queries. This information may be used to improve the relevancy of results provided by Droppz Services. Except in limited instances to ensure quality of Droppz Services over the Internet, such information will not be associated with your IP address.

This Privacy Policy does not limit our use or disclosure of non-personal information and we reserve the right to use and disclose non-personal information to our partners, advertisers, product manufacturers and other third parties at our discretion (including aggregated, deidentified and/or anonymized information about our users and their use of Droppz Services). We do not use or respond to “do not track” signals that may be sent from your web browser. If we do combine non-personal information with personal information, the combined information will be treated as personal information for as long as it remains combined.

 

We also use the data to operate our business, which includes analyzing our performance, meeting our legal obligations, and doing research. When we ask you to provide personal information, you can decline, but if you do, you may not be able to access the Droppz Services.

3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

We may share information in specific situations described in this section and/or with the following third parties. When you select our Vendors to process your order, we send the Vendors your name, email address, phone number, reservation time, delivery location, and the specific products and the quantities you ordered. We may also provide our Vendors you select with suggested products for you based upon information that we gather about your shopping history or consumers with similar shopping histories. When Droppz marketplace technology is integrated with a Vendors website, you may submit personal information to the Vendor as well as Droppz, and in that case your information is also governed by the Vendor's privacy policies. We encourage you to carefully read the privacy policy of any Vendor's website you visit.

 

We may employ third party companies and individuals to facilitate our provision of Droppz Services, to provide Droppz Services on our behalf, provide customer support, perform service-related services (e.g., maintenance services, database management, web analytics and improvement of the Services features) or to assist us in analyzing how Droppz Services are used. Over the last twelve (12) months, Droppz has disclosed for business purposes the following categories of personal information to third parties: identifiers, customer records information, commercial information, internet or other electronic network activity information, and geolocation data. These third parties may have access to your personal information, but only to the extent needed to perform these tasks on our behalf, and we will contractually require them to protect and safeguard your personal information in accordance with applicable laws. If you choose to purchase merchandise, products and/or services, on or through features on Droppz Services, we may forward your personal information to third parties for services such as credit card or other payment processing, order fulfillment, credit pre-authorization, and address verification.

 

We have partnered with financial services software companies (“Aeropay”), (“CanPay”), (“DutchiePay”), and (“PosabitPay”)  to offer you ACH Payments and the DropPass Subscription program. When you create an account with us and connect a bank account to allow for ACH Payments and the DropPass Subscription program, you're choosing one or all of our financial services providers by creating a financial provider account. It is your responsibility to make sure the data you provide us is accurate and complete. You must comply also with the financial service provider’s privacy policy (the “Financial Service Provider’s Privacy Policy”) when creating or using your account with us for ACH Payments and the Droppz Subscription program. The Financial Service Provider’s Privacy Policy may be modified from time to time, and the governing version is incorporated by reference into this Privacy Policy.”

 

We may also disclose your information to unaffiliated third parties for advertising and marketing purposes. Over the last twelve (12) months, Droppz has sold and shared the following categories of personal information to third parties: commercial information, internet or other electronic network activity information, and geolocation data. Pursuant to California’s “Shine the Light Act,” California residents are permitted to request information about the manner in which we share certain categories of information with third parties for their marketing use. Please send an email to info@droppzapp.com to request a copy of our disclosure pursuant to California law. While we will require third parties to follow applicable laws, and will not authorize them to use this information except for the express purpose for which it is provided, we do not bear any responsibility for any actions or policies of third parties. However, if you opt out of internet-based advertising, we will not disclose your information to any third parties for this purpose.

 

Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

When we use Google Analytics. We may share your information with Google Analytics to track and analyze the use of the Services. To opt out of being tracked by Google Analytics across the Services, visit https://tools.google.com/dlpage/gaoptout. By providing your mobile phone number and/or email address through Droppz Services or to our Vendors, you expressly consent to receive informational and transactional messages at the mobile phone number and/or email address provided to Droppz and/or our Vendor. Standard per minute call and message and data rates may apply. You may opt-out of receiving these messages at any time in your account profile.

 

4. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). Droppz retains your personal information as is reasonably necessary to provide you with the Services; however, if you have not accessed the Droppz Services for twelve (12) months, your information will be deleted.

5. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. Droppz and our service providers implement security measures designed to protect your information from unauthorized access, disclosure or accidental loss or destruction. We utilize appropriate physical, technical and managerial safeguards designed to protect the information we collect from or about our users. Droppz physical infrastructure is hosted and managed within Amazon’s secure data centers located in the United States and utilizes the Amazon Web Service (AWS) technology. Amazon continually manages risk and undergoes recurring assessments to ensure compliance with industry standards. However, despite AWS and our safeguards to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information 

 

6. DO WE COLLECT INFORMATION FROM MINORS?

Our app is only accessible to adults who are 21 years of age or older. We do not knowingly collect data from or market to minors under 21 years of age. By using the Services, that you are at least 21 years old and have provided the proper legal identification to Droppz and consent to our Services. If we learn that personal information from users less than 21 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such users from our records. 7. WHAT ARE YOUR PRIVACY RIGHTS?

You have choices that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time through the options we provide .

In some areas, you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. Withdrawing your consent: You can withdraw your consent at any time by stopping your use of the Droppz Services or as specified herein. If you have questions or comments about your privacy rights, you may email us at info@droppzapp.com

Nevada

If you are a Nevada resident, you have the right to opt-out of the sale of your personal information. If you wish to exercise the right to opt-out, please do so at this link: www.droppzapp.com/do-not-sell-my-information

California 

If you are a California resident, the California Consumer Protection Act provides you with specific rights regarding your personal information. You have the right to: Request that Droppz disclose to you the categories and specific pieces of personal information we have collected, sold and/or shared. Direct Droppz to limit the use of your sensitive personal information

To exercise the rights set forth above, you may submit a request to us by visiting info@droppzapp.com or calling 1-810-510-0387. If Droppz deletes your personal information, Droppz will both render certain personal information about you permanently unrecoverable and also deidentify certain personal information.

 

8. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

 

9. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be “selling” of your personal information. Droppz has sold, or shared information to third parties for a business or commercial purpose in the preceding twelve (12) months. If you are a resident of California, Colorado, Connecticut, Utah or Virginia, you are granted specific rights regarding access to your personal information. We have collected the following categories of personal information in the past twelve (12) months:

J. Inferences drawn from collected personal information: Inferences drawn from any of the collected personal information listed above to create a profile or summary about, for example, an individual’s preferences and characteristics.

K. Sensitive personal Information: We will use and retain the collected personal information as needed to provide the Services or for:

Category B – As long as the user has an account with us

We may also collect other personal information outside of these categories through instances where you interact with us in person, online, or by phone or mail in the context of:

Receiving help through our customer support channels;

Participation in customer surveys or contests; and

Facilitation in the delivery of our Services and to respond to your inquiries.

 

California Residents

California Civil Code Section 1798.83, also known as the “Shine The Light” law permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below. This section applies only to California residents. Under the California Consumer Privacy Act (CCPA), you have the rights listed below.

 

Right to request deletion of the data — Request to delete

You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.

10. DO WE MAKE UPDATES TO THIS NOTICE?

We may update this privacy notice from time to time. The updated version will be indicated by an updated “Last Updated” date and the updated version will be effective as soon as it is accessible. When we do update this Privacy Policy, we will also revise the “Last Updated” date at the top of the Privacy Policy. If we make changes to this Privacy Policy that, in our discretion, we consider significant, we will post the updated Privacy Policy on our website and we may also send emails to our users who have created a Droppz account containing a link to the revised Privacy Policy. Please review this Privacy Policy periodically to stay informed about how we are protecting the Personal Information we collect. If you continue to use Droppz Services after we post an update to this Privacy Policy, you are indicating your acceptance of the updated Privacy Policy.
